Debt Collector Revealing Account Number
An envelope revealing a consumer’s account number through a clear plastic window violates the Fair Debt Collection Practices Act (“FDCPA”). If you receive a collection letter in an envelope with a clear plastic window take a look at what is visible on the letter through the plastic window. Can you see a set of numbers? If so, these numbers very well could be the account number. This is an invasion of your privacy. Is there a “quick response” (“QR”)code that can be seen? This is a barcode like image that can be read from a cell phone. If scanning the code with your cell phone reveals the account number, the collector violated the FDCPA. Disclosing your account number to the public is a serious matter. Debt collectors should avoid using account numbers or QR codes that can be seen through the viewing area of clear plastic envelope windows. If you receive a debt collection letter in an envelope with a clear plastic window where you can see a QR code or a set of numbers, call my office for a free consultation. Protect your privacy !
